Skydda motorcyklisternas data

FEMA har svarat EU-kommissionen i en konsultation om riktlinjer för åtkomst till data från motorfordon. FEMA anser att man glömt bort MC då man diskuterar fordon och kräver att motorcyklisterna ska inkluderas i riktlinjer för data vad gäller motorfordon som publicerades av European Data Protection (EDPB) Board i februari i år.

EDPB har publicerat riktlinjer hur man ska hantera personliga data i samband med uppkopplade fordon och applikationer relaterade till mobilitet. EU-kommissionen har just nu en öppen konsultation som avslutas den 1 maj 2020. FEMA  har självklart svarat  då man representerar de europeiska motorcyklisterna. FEMA  kräver att motorcyklar ska inkluderas i riktlinjerna.

FEMA har gått igenom dessa riktlinjer och anser att riktlinjerna ger ett bra skydd till fordonsägare och deras data så långt det är möjligt. FEMA konstaterade dock att omfattningen av riktlinjerna inte är helt klar. På vissa ställen nämner riktlinjerna begreppet ”fordon” och på vissa ställen ”bilar” utan att definiera begreppet ”fordon” närmare.

Eftersom begreppet ”bilar” används kan det antas att bilar var vad EDPB hade i åtanke när riktlinjerna skrevs. Oftas används ordet ”fordon” för fyrhjuliga fordon i EU-lagstiftning och därför kan man anta att det är just bilar som menas i samband med dessa riktlinjerna. 

Motorcyklar och andra fordon i kategori L är vanligtvis inte inkluderade i EU-lagstiftningen om de inte nämns specifikt. L-fordon är inte heller specifikt nämnda i EDPB:s riktlinjer. FEMA tvivlar på att motorcyklar överhuvudtaget ingår i riktlinjerna fast de ska vara inkluderade. Därför har FEMA kontaktat EDPB för att tvåhjuliga motorfordon ska inkluderas.

 FEMA:s  svar till EDPB: 
View of FEMA on the EDPB Guidelines 1/2020 on processing personal data in the context of connected vehicles and mobility related applications (version 1, adopted 28 January 2020): “We are concerned about the use of the data of vehicles, including motorcycles and other powered two- and three-wheeled vehicles, by motorcycle manufacturers and others and the privacy of their owners. Therefor we are happy with the Guidelines of EDPB and think they can contribute to the enforcement of right of ownership of data and the protection of the personal life space of vehicle owners and -users. However, the scope of the Guidelines is not clear enough. In the Guidelines (connected) vehicles are mentioned in several places, while in other places cars are mentioned. This gives the impression that only cars (category M1 vehicles?) are in the scope of the Guidelines and not other vehicles like all categories L, N1, M2, N2. Some motorcycles are already connected and at least one brand (BMW) already downloads (personal) data from the motorcycle when it is serviced by a BMW dealer of workshop without the explicit consent or often even knowledge from the owner. As a federation of motorcyclists’ rights organizations in Europe we are very concerned with the developments in data gathering and processing and we think that motorcycles and other L-category vehicles must be explicit included in the scope of the Guidelines.”
